Health and Safety Documents

Implementing and maintaining your own OHS programme takes a lot of work and just as much paperwork. Keeping Health & Safety documents is an important way to keep your workplace Health and safety compliant.

  • Appointments:
    Every employer who has more than twenty employees in his employment at any workplace, and within four months after commencing business or immediately the number of his employees exceeds twenty shall designate in writing for a specific period health and safety representatives for such workplace or different sections thereof.
  • Nominations and elections:
    The employer and employees and their representatives shall consult in good faith regarding the arrangements and procedures for the nomination and election and subsequent designation of suitable health and safety representatives. These appointments, including the period of the person in office, will be included in the designation in writing.
  • Duties regarding nominations and elections:
    Any dispute regarding nominations and elections shall be referred to the inspector for arbitration, whose decision shall be final. Should both parties not agree within fourteen days on an arbitrator, the employer shall notify the president of the Industrial Court in writing, who shall in consultation with the chief inspector designate an arbitrator, whose decision shall be final.
  • Designation:
    Only full-time employees at a specific workplace and who are acquainted with the conditions and activities at that workplace or section thereof shall be eligible for designation as health and safety representative for that workplace or section.
  • Number of health and safety representatives required:
    • 1 : 100 employees or part thereof in shops and offices
      •
    • 1 : 50 employees or part thereof in other workplaces
      •
  • Additional representatives:
    The inspector may in writing direct the employer to designate more health and safety representatives for that workplace or section thereof.
